Playing Key Roles in the Mediation Process
Mediation is a procedure in which the parties to a legal dispute meet with a neutral mediator and attempt to come to a negotiated resolution. The use of mediation is particularly common in divorce cases. Our attorneys are prepared to take either of the following roles in mediation:
- Serving as neutral mediators: Two of our attorneys have been trained to serve as mediators, and we are frequently called upon to mediate divorce cases based on both our skill in mediation and our extensive experience in litigated divorce matters.
- Counseling clients through mediation: We also strongly advise that parties entering mediation seek independent legal advice, and we frequently represent clients in mediation proceedings (when permitted) and advise them on their rights and options.
Mediation is increasingly ordered by the courts in contested child custody and visitation cases, and it can also be helpful on a voluntary basis for parties who are interested in settling their issues out of court but have not been able to come to full agreement on their own.
